How much do you pay for custody of a disabled person?

The general rule is that the guardian of an adult incompetent person performs his or her duties free of charge, but in some cases he or she may still receive small payments from the State.

What is the impact on the level of contributions?

In the first step, potential guardians need to collect a package of papers that will confirm that they cannot care for a minor mother or father; only documentary evidence is taken into account; the simplest option is for parents to apply to the DOS for consideration.

After a period of time, parents will be able to take care of their children again, the agreement will be cancelled without any difficulty, and temporary foster care will be subject to the same payment as full-time carers under the current legislation.

Types and amount of payments

Payments to persons with custody responsibilities fall into the following categories:

Juvenile children

The guardianship payments are made to a person who has been appointed by the legal representative of a minor under the age of 14 without parental care, and compensation is established at the federal and regional levels.

The guardian is entitled to the following benefits:

  • For the birth of a child;
  • When a child is placed in foster care;
  • To care for children under the age of 1.5;
  • Regional compensation.

Compensation for the birth of a child shall be awarded to the guardian if the parents have not done so.

The amount of payment since February 2023 is 16 759.09 p.m.

A person also receives assistance from the State for having accepted a child into his or her family.

The amount of the lump sum grant in 2023 after indexation was 16 759.09 pp. In 2017, a benefit of 16,360.33 pp was granted. If a child under seven years of age is disabled, the benefit is much higher - 128,053.08 pp.

Benefits should be applied for at least six months after the child ' s guardianship has been established.

Some citizens are interested in how many people have been added to the lump sum since 6 July 2023 and, in accordance with Government Decision No. 74 of 26 January 1988, were indexed as early as February of this year, no further increases are planned.

Taking care of a child under the age of 1.5

Like parents, the guardian is entitled to receive monthly compensation for the care of a child until the child is one and a half years old.

Workers are entitled to 40 per cent of the average monthly wage and the maximum amount of compensation is set at 24 536.57 p.

A citizen who has an average monthly wage below the minimum legal age or has worked for up to six months is entitled to a guardian ' s allowance based on the amount of the SMIC.

In 2023, it equals 9,489 p.p., so they will repay 3,795.60 p.p.

If a person is not employed or is an entrepreneur, 3,142.33 p.p. is paid for the first child, 6,284.65 p.p. is paid for the second child and the next child.

To the incompetent.

As a general rule, guardianship of an adult who has been declared incapable implies that care is provided free of charge; however, in some special cases, compensation is granted.

The allowance is payable if the person cares for:

  • A disabled person in the first group (disabled from childhood - exception);
  • An elderly person who needs regular care;
  • 80-year-old citizen.

Persons who meet the following criteria may receive such assistance from the State:

  • Capacity to work;
  • Absence of work;
  • The age range is 14 to 55 for women and 60 for men.

If a citizen in need of care is found by a court to be incompetent, the allowance shall be paid to the guardian.

Most often, a person retains legal capacity or is limited in part.

In such a case, the legal person is given custody, not custody.

The amount of compensation for a disabled citizen is 1,200 p. It has not been indexed since 2006; in the northern regions, the amount of the allowance is calculated on the basis of the district coefficient.

It is common for a child to have parents who are temporarily unable to perform their duties; temporary guardianship is established in such a situation; usually, relatives become guardians.

Temporary guardians have the same status as permanent guardians, so they also receive financial assistance from the State.

The exception is that they are unable to dispose of the property of the guardian; payment shall cease after the termination of the custody contract and the return of the child to the parents.

How much is paid to adoptive parents

The placement of orphaned children in foster care is a form of care, together with guardianship.

A person who wishes to be a foster parent enters into a contract with the guardianship authorities and determines how long the guardian will spend in the family.

The type and amount of compensation depends on the age and number of children, the state of health, the region of residence and the material condition of the family.

Foster parents are provided with financial assistance in the form of:

  • Maternity benefits up to 70 calendar days for one child and 110 for two or more;
  • A one-time allowance for the placement of a child in a family of 16 759.09 p.p.;
  • Monthly payments up to 1.5 years;
  • Monthly compensation until the child is three years old;
  • Maternal capital;
  • Pay for parental responsibilities (the amount is set at the regional level).

Procedures for processing

The procedure for awarding payments is simple, with the guardianship authorities signing a custody contract first.

A package of documents is then submitted to the local social security authorities.
